A complex legal situation has arisen in Germany involving Sven Liebich, who was convicted of crimes including slander, incitement to hatred, provocation, and insults. After his sentencing was finalized, Liebich declared in 2023 a change in gender identity.

“Body Immunity” and Prison placement
German law stipulates that a personS declared gender is legally recognized, and cannot be challenged. Liebich, now using the name Marla Svenja Liebich, applied to serve an 18-month sentence at Chemnitz Women’s Prison. Despite this application, Liebich initially did not report to begin serving the sentence, prompting an additional arrest warrant from the prosecutor’s office.

Political and Legal Debate
The case has sparked debate within the German government. Interior Minister Alexander Dobrindt argued that Liebich is abusing a right granted by a law enacted in November 2024 that simplifies gender and name changes, and called for a review of the legislation. However, the Social Democratic Party (SPD), one of the parties that supported the law, opposes any revisions.
The Halle prosecutor’s office stated they are searching for “Sven or Marla Svenja” and confirmed the individual will be placed in Chemnitz women’s Prison, based on the registered gender.
