A federal judge in Boston, Allison Burroughs, has overturned teh Trump administrationS decision to withdraw over $2.6 billion in federal funding from Harvard University, deeming the action a violation of the First amendment. The judge “cancels and dismisses” the administration’s decisions, according to her order.
Background: Trump Administration’s Accusations Against Harvard
The dispute began after Donald Trump, since returning to the White House in January 2024, repeatedly accused American university deans of fostering a “woke” ideological environment – a term often used by conservatives to discredit progressive ideas. Trump also alleged that Harvard failed to adequately protect Jewish and Israeli students during campus demonstrations calling for a ceasefire in the Gaza Strip. RTBF reports that these accusations prompted the administration to withdraw federal subsidies, including those for health programs, and revoke Harvard’s Sevis certification, essential for authorizing foreign students to study in the U.S.
Judge Acknowledges Anti-Semitism Concerns, But Finds No Link to Funding Cuts
While acknowledging the issue of anti-Semitism on campus, Judge Burroughs stated, “anti-Semitism, like other forms of discrimination or prejudice, is intolerable. And it is indeed clear, by Harvard’s own admission, that the university has been prey to anti-Semitism in recent years and could have (and had to) better deal with this problem.” Though, the judge found “little link between the fields of research affected by granting gels and anti-Semitism.”
Ruling: anti-Semitism Used as a Pretext
The court concluded that the Trump administration “used anti-semitism as a smoke screen to lead a targeted and ideologically motivated attack against the country’s most prestigious universities.” This suggests the funding cuts were not based on legitimate concerns about anti-Semitism, but rather on disagreement with the universities’ perceived ideological leanings.
