During the two-hour confirmation hearing before the Senate Health, Education, Labor, and Pensions (HELP) committee, the preventive medicine physician from rural New Mexico who previously worked in the White House during both Trump terms avoided stating personal policy positions. Instead, she repeatedly referred lawmakers to existing agency guidance and product approvals.

Vaccine Safety and Executive Order Oversight

HELP Committee Chairman Sen. Bill Cassidy, R-La., opened the proceedings by questioning Overton’s past participation in an executive order signing that overhauled the childhood vaccine schedule. Cassidy, a physician and liver doctor, stated that the executive order was based on zero scientific evidence and emphasized that individuals risk dying if they do not receive vaccinations. When Cassidy asked whether the measles, mumps, and rubella (MMR) vaccine is lethal, Overton replied that it is not. Senator, every vaccine on the U.S. market right now are safe and effective, according to the FDA, Overton told Cassidy. Overton added that immunization remains the best tool in the public health response against rising measles cases nationwide. However, both Cassidy and Ranking Member Sen. Bernie Sanders, I-Vt., pressed Overton on whether she would stand up to the president in policymaking decisions, prompting Overton to respond that she would follow statutory law.

Debate Over Medication Abortion and Mifepristone

Sen. Patty Murray, D-Wash., questioned Overton regarding the safety and efficacy of the abortion pill mifepristone, noting that Health and Human Services Secretary Robert F. Kennedy Jr. launched an FDA safety review of the drug last year. I know that it has met the safety and efficacy standard according to the FDA review, Overton replied during the hearing. Murray, who previously labeled Overton as an anti-abortion extremist, criticized a 2023 article published by Overton that Murray said incorrectly characterized medication abortion as dangerous to women. Murray maintained that the FDA approved the medication 26 years ago and requires leadership committed to science-based decisions. When Murray asked whether an intrauterine device (IUD) functions as an abortifacient, Overton did not give a direct answer, stating instead that she would review prior agency determinations based on safety and efficacy standards if confirmed.

Deflecting Specific Policy Pledges

Throughout the session, lawmakers from both parties noted that the nominee provided minimal insight into her personal views regarding top regulatory issues facing the agency. Sen. Chris Murphy, D-Conn., told Overton that she had done a pretty good job of avoiding answering questions so far. The hearing also touched upon safety questions regarding acetaminophen use during pregnancy and potential links to autism, following warnings issued by Trump earlier in September. If confirmed, Overton would succeed Marty Makary, who resigned as FDA commissioner following public disputes with lawmakers, major pharmaceutical companies, and the administration over fruit-flavored vapes. Kyle Diamantas has served as acting FDA commissioner since May 2026.
