A court in Rome has ruled that Netflix illegally increased monthly subscription rates for its Italian users between 2017 and 2024, ordering the streaming service to issue refunds to affected subscribers.
The ruling follows a complaint filed by the consumer advocacy group Movimento Consumatori. The court found that Netflix violated Italy’s national consumer code, which prohibits corporations from unilaterally raising rates on subscription-based services without providing a legitimate reason for the increase and offering advanced notice.
Netflix has 90 days from the April 1, 2026, ruling to comply and begin issuing refunds. Failure to do so will result in a daily fine of $800.
Financial Impact and Refund Estimates
Estimates indicate that Netflix’s total refund liability in Italy could exceed $2.3 billion if all eligible subscribers receive payment. As of the end of 2025, Netflix had approximately 5.4 million paid subscribers in Italy.
Lawyers for the consumer group have specified the potential refund amounts for individual users from 2017 to the present:
- Premium subscribers are due a refund of $577 (approximately €500).
- Standard subscribers are due a refund of $288 (approximately €250).
In addition to the refunds, the court ordered Netflix to lower its monthly rates. Premium subscriptions are to be reduced from $23.13 to $13.87, while standard subscriptions are to be lowered from $16.19 to $11.56.
Corporate Response and Legal Strategy
Netflix has announced its intention to appeal the decision. In a statement, the company asserted that its terms have always been consistent with Italian law and practices, stating, At Netflix, our members come first. We take consumer rights very seriously
.
The legal challenge centers on the claim that Netflix made no sweeping changes to its service to justify the exponential price hikes occurring over the seven-year period.
Broader Market and Regulatory Context
The decision in Rome may serve as a landmark action affecting other subscription-based video-on-demand platforms. Netflix is reportedly facing similar pricing litigation in Germany, Spain, and Poland.
This legal pressure in Europe coincides with price adjustments in other markets. In January 2026, Netflix announced price hikes in the United States ranging from 13% to 18%, the second such increase in the U.S. Within a 12-month period.
According to reports from Italian outlets including Corriere della Sera, and HDblog.it, more than 110,000 users have already joined the effort to seek refunds pending the outcome of the appeal.
