Legal Challenge Launched Over Irish Airspace use for Flights Transporting Weapons to Israel
A important legal challenge has been initiated at the High Court, questioning the use of Irish airspace for flights allegedly transporting weapons to Israel. the campaign group Uplift,in conjunction with news organisation The Ditch and Irish-born Palestinian surgeon Dr. ahmed El Mokhallalati, have lodged papers seeking permission for a judicial review.
The applicants contend that the Minister for transport has failed to adequately investigate claims that Irish airspace has been utilized for the transit of weapons destined for the Israeli Defense Force’s operations in gaza. Furthermore, they argue that a portion of the relevant legislation is unconstitutional.
The legal filing also asserts that the Irish Government is in breach of export legislation through its granting of ”dual use export licences” for goods believed to be used in the manufacture of weapons.uplift highlighted a report published last May, which indicated a surge in “dual use” trade between Ireland and Israel following the commencement of military action in Gaza. The group expressed concern that goods originating from Ireland could be exported for use by Israeli companies involved in weapons and military equipment production.
However, the Government has stated that the level of dual-use exports is unrelated to the ongoing conflict in Gaza.The Ditch has presented research tracking flights that appear to have transported weapons through Irish airspace to Israel, asserting that clear evidence supports these claims. In their statement of grounds, they argue that such actions are legally impermissible, facilitate genocide against the Palestinian people, and that no exemptions were sought for the transportation of these weapons.
the applicants specifically accuse the Minister for Transport of failing in his statutory duties to investigate the allegations concerning Irish airspace. They also claim the Minister for Enterprise, Trade and Employment has been unlawfully granting dual-use export licences.
Dr. ahmed El Mokhallalati, who was born in Dublin, shared his personal experiences in Gaza, explaining his motivation to act against the ongoing violence. He stated his belief that Ireland has been complicit in facilitating the transfer of weapons and munitions used against the people of Gaza, weapons he claims are responsible for the destruction of his home, the deaths of friends and family, and immense suffering. He expressed disappointment at the government’s perceived inaction and felt compelled to take legal recourse.
Uplift is hopeful for a High court hearing to seek leave for the judicial review proceedings before the end of the current week.
