Man’s Trial for Sexual Assault Delayed as Flight Risk Concerns Surface
A trial involving a man accused of sexual assault has been postponed, with the court citing concerns that the defendant may be a flight risk.The incident, which occurred earlier this year, involved a woman who was heavily intoxicated at the time.
The Night in Question: A Confusing Account
The court heard that the man and woman did not know each other prior to the incident, having met earlier on the same day. video footage from the event captured the woman, who was described as heavily drunk, telling the man to stop. Bystanders intervened, pulling the man away from the woman, and police arrived shortly thereafter.
Initially, the man was not arrested, as bystanders suggested the pair knew each other. However, the man’s account to the police was inconsistent. He first claimed that he and the woman had engaged in consensual sex, stating they “made love.” Later, he recanted this, saying he had no memory of the evening due to his intoxication.
Defense Arguments and court’s Decision
The defense lawyer,Sophie Hof,described the situation as “complex.” She suggested that passersby might have been observing the pair because they appeared to be “kissing and stroking.” Hof emphasized the ambiguity of the situation, stating, “This case is not black or white. He doesn’t remember anything. He is ashamed, towards the victim, and how he could get so drunk.”
A request to lift the man’s pre-trial detention was denied by the court. The judge ruled that the man posed a flight risk, leading to the postponement of the trial. The proceedings are now scheduled to commence in October.
