Though, just a year after her film debut, Ferrer finds herself unexpectedly embroiled in a contentious legal battle between Lively and the film’s director, Justin Baldoni, with both parties issuing subpoenas for her testimony.
Allegations of Harassment and Control
On Sunday, Ferrer’s attorney, Sanford Michelman, filed a claim alleging that Baldoni is engaging in “harassing” behavior and attempting to leverage his financial influence to dictate Ferrer’s response to Lively’s subpoena.The core of the issue, according to Michelman, is Ferrer’s desire to avoid being further entangled in the dispute. lively has filed a lawsuit against Baldoni,accusing him of sexual harassment and alleging a deliberate campaign to damage her reputation following her initial complaints.
The lawsuit details a specific instance where Baldoni allegedly added a scene depicting Young Lily’s loss of virginity to the film. Lively claims that after filming, Baldoni made a suggestive comment to the young actors, stating, “I know I’m not supposed to say this, but that was hot.”
Conflicting Accounts and a Questionable Legal Argument
Baldoni’s legal team responded by presenting text messages from Ferrer describing him as a “great director” and “wonderful to work with.” They argue that Ferrer’s shift in demeanor occurred as the conflict between Lively and baldoni escalated during the film’s promotional period, leading her to distance herself from the director.
The situation became further complex when Lively’s lawyers subpoenaed Ferrer in February, seeking all communications between her and the involved parties. This necessitated Ferrer securing legal counsel and requesting financial coverage from Baldoni’s team, given their employer-employee relationship.
Michelman asserts that Baldoni attempted to condition the financial guarantee on gaining control over Ferrer’s testimony or,at the very least,her legal portrayal.Alarmingly, Michelman claims that the producers’ lawyer even cited a fabricated legal case – believed to be a product of an AI hallucination
– to justify this leverage.
A Battle Over Service and Accusations of Bullying
The dispute intensified when Baldoni’s team requested that Michelman accept service of the subpoena on Ferrer’s behalf, a request he refused. Baldoni’s lawyers are now seeking a court order for “alternative service,” effectively forcing Michelman to accept the subpoena. Michelman contends that they have not demonstrated Ferrer is actively evading service,noting that process servers have been unable to locate her at addresses in Brooklyn and Sag Harbor.
Ferrer’s legal team argues that Baldoni’s actions, including the pursuit of alternative service and the handling of the Lively subpoena, represent a “broader pattern of conduct” intended to “bully” Ferrer.Michelman stated, “While Ms.Ferrer will faithfully comply with her legal obligations under any subpoena, summons or court order, she obviously will not be intimidated or extorted by any party to otherwise participate in the proceedings.” Ferrer is requesting the court deny Baldoni’s motion and impose sanctions.
