Israeli prosecutors announced on Monday, February 16, 2026, their intention to indict an Israeli settler for the killing of a Palestinian activist, Awdah Hathaleen. The decision marks a rare step towards prosecuting violence committed by Jewish settlers in the occupied West Bank, a region experiencing a surge in attacks and home demolitions.

The settler, identified as Yinon Levi, is expected to face charges of reckless homicide. If convicted, he could face a maximum prison sentence of 12 years, according to prosecutors. The announcement follows a period of heightened scrutiny surrounding the circumstances of Hathaleen’s death and a previous release from custody citing a lack of evidence.

Hathaleen, 31, was killed in July 2025 in the West Bank village of Umm al-Khair during a confrontation with settlers. The incident gained significant attention due to its documentation on video from multiple angles, including footage reportedly captured by Hathaleen himself. The videos appear to show Levi firing a weapon in the direction of those present.

The case is particularly notable because Hathaleen was involved in the 2025 Oscar-winning film “No Other Land,” which chronicles the struggles of Palestinian villagers fighting to remain on their land. His death amplified existing concerns about the escalating violence and displacement faced by Palestinian communities in the West Bank.

Levi was previously released from custody six months ago after an Israeli judge determined there was insufficient evidence to link him to the shooting. However, the State Attorney General’s office has now initiated proceedings for indictment, signaling a shift in the legal approach to settler violence.

The decision to pursue charges against Levi comes amid a broader context of increasing tensions in the region. Attacks by settlers and demolitions of Palestinian homes have reportedly spiked dramatically over the past two years. According to data from the Israeli rights group Yesh Din, prosecutions resulting in convictions for settler violence remain exceedingly rare, with over 90 percent of cases between 2005 and 2025 not resulting in charges and only 3% leading to a conviction.

The Hathaleen family has expressed mixed reactions to the impending indictment. While welcoming the move as a step towards justice, Khalil Hathaleen, Awdah’s brother, argued that the charge of reckless homicide is insufficient, stating that the killing appeared intentional and premeditated. “It was an intentional killing in broad daylight, with prior intent and premeditation,” he said.

Eitan Peleg, the family’s lawyer, expressed hope that the charges would serve as a deterrent. Enforcement in the West Bank, as far as crimes by Jews against Palestinians go, is practically non-existent, he said, adding that the decision to indict Levi could be a warning to all the criminals.

Levi has also been subject to international sanctions, with the United States and other Western countries reportedly levying sanctions against him over allegations of violence towards Palestinians. This international pressure may have contributed to the decision to move forward with the prosecution.

The indictment, when formally filed, will be closely watched by international observers and human rights organizations. The case represents a test of Israel’s willingness to address settler violence and ensure accountability for perpetrators. The outcome could have significant implications for the future of Israeli-Palestinian relations and the broader stability of the region.

Instances of settler violence have increased since the Hamas-led attacks of October 7, 2023 and the subsequent war in Gaza. This escalation has raised concerns about a further deterioration of the security situation in the West Bank and the potential for increased conflict between Israeli settlers and Palestinian communities.

The rare decision to prosecute Levi underscores the complexities of the Israeli-Palestinian conflict and the challenges of addressing violence in the occupied territories. The case highlights the need for a more robust legal framework to address settler violence and protect the rights of Palestinians living in the West Bank.
