Japan Urged to Defend International Criminal Court Amidst US Sanctions
The Growing Pressure on the ICC
On October 9, 2024, Human Rights Watch, in collaboration with Tokyo-based Human Rights Now and Peace Boat, hosted an event at the Japanese Diet. The purpose was to advocate for increased Japanese government support for the International criminal Court (ICC), which is facing unprecedented pressure from the United States.
The ICC serves as a court of last resort, investigating and prosecuting individuals responsible for the most serious crimes of international concern – genocide, war crimes, crimes against humanity, and the crime of aggression – when national courts are unwilling or unable to do so. Its independence is crucial for ensuring accountability for atrocities worldwide.
US Sanctions and Their Motivation
In February 2024, then-US President Donald Trump signed an executive order authorizing sanctions against the ICC and individuals supporting it. This action was explicitly intended to protect Israeli and US officials from potential examination and prosecution by the court. The move was widely condemned by human rights organizations as an attack on international justice.
This escalation followed the ICC’s November 2024 decision to issue arrest warrants for Israeli Prime Minister Benjamin Netanyahu, former Defense Minister Yoav Gallant, and three leaders of Hamas, including a now-deceased official, concerning alleged war crimes committed in the context of the Israel-Palestine conflict.
The Impact of US Sanctions
The US sanctions are having notable and detrimental effects on the ICC’s ability to function effectively. These effects include hindering investigations, limiting access to crucial evidence, and perhaps jeopardizing the safety of witnesses and victims.
Human Rights First notes that the sanctions create a chilling effect, discouraging cooperation with the ICC and undermining the pursuit of justice for victims of grave crimes. The sanctions also raise concerns about the US’s commitment to the rule of law and its willingness to hold perpetrators of atrocities accountable.
Japan’s Role and International Response
The event at the japanese Diet aimed to encourage the Japanese government to publicly and actively defend the ICC against US pressure. Japan, as a strong advocate for the rule of law, is uniquely positioned to play a leadership role in supporting the court.
Several other countries and international organizations have also expressed concern over the US sanctions, emphasizing the importance of the ICC’s independence and its mandate to investigate
