Jordan Neely died from multiple factors, rather than a chokehold, according to Dr. Satish Chundru, a forensic pathologist testifying for the defense in the trial of Daniel Penny. Penny faces charges of manslaughter and criminally negligent homicide for Neely’s death on a New York City subway train in May 2023.
Dr. Chundru stated he reviewed Neely’s autopsy report, toxicology reports, and witness statements. He claimed that Neely’s death resulted from a combination of factors, including sickle cell crisis, schizophrenia, physical restraint, and synthetic marijuana in his system. This contradicted the findings of Dr. Cynthia Harris, the New York City medical examiner, who attributed Neely’s death to asphyxia caused by the chokehold.
Neely, aged 30, exhibited distressed behavior before the confrontation, expressing hunger and a desire to return to jail. Penny, 26, applied a chokehold on Neely for about six minutes, according to prosecutors. A bystander video of the incident sparked public debate, with some supporting Penny’s actions and others condemning them.
Dr. Chundru criticized Dr. Harris for making a premature conclusion about the cause of death before completing toxicology tests. Dr. Harris maintained her view based on autopsy findings and the context of the incident, stating her opinion would not have changed with further toxicology results.
During the trial, Penny’s defense called character witnesses, including his mother and sister, to portray him as empathetic and honest. They discussed his upbringing and military service. However, prosecutors presented evidence suggesting he misled police during an interview following the incident.
