Jury selection began on April 14, 2026, in Manhattan criminal court for the retrial of former movie mogul Harvey Weinstein. The proceedings center on a rape charge involving hairstylist and actor Jessica Mann.
Weinstein is accused of the third-degree rape of Mann, who appeared in the 2015 romantic comedy This Isn’t Funny
. This marks the third time jurors will weigh the evidence regarding this specific charge.
Previous Trial and Mistrial
The current retrial follows a mistrial declared in June 2025. That previous trial ended after the jury foreperson refused to return to the courtroom to continue deliberations, a decision that occurred amid a feud within the jury room.
Judge Curtis Farber is presiding over the current proceedings. During the hearing on April 14, 2026, Judge Farber stated that the defense had sought to delay the trial. The process of selecting 12 jurors is expected to last several days.
Legal Status and Health
Weinstein, who is 74 years old, appeared in court wheelchair-bound due to ill health. Despite the current New York proceedings, he remains imprisoned for other offenses.

He is currently serving a 16-year prison term resulting from a California case involving the rape of a European actress more than a decade ago. Weinstein is appealing that conviction, with a hearing scheduled for April 23, 2026.
Additional Prosecutions
The current case is part of a series of prosecutions following the 2017 public emergence of sexual assault allegations against Weinstein, which contributed to the MeToo movement.
In June 2025, a jury convicted Weinstein of sexual assault against movie producer Miriam Haley. Weinstein is currently appealing that conviction. In a separate matter, he was acquitted of sexual assault charges involving Kaja Sokola, a Polish-born actress.
He is hopeful and expects a fair process where the facts will vindicate him.
