According to Nepra, K-Electric attempted to attribute the primary cause of the breakdown to disturbances within the National Transmission and Dispatch Company’s (NTDC) 500 kV network, leading to a cascading failure within its own system.However, Nepra rejected this justification.
Nepra’s Concerns About K-Electric’s Preparedness
Nepra stated that while interconnected power systems are inherently vulnerable to disruptions in the larger grid, K-Electric’s argument that its stability is “entirely dependent” on the NTDC network raises serious concerns. The authority questioned K-Electric’s preparedness as a vertically integrated utility, suggesting a lack of independent operational resilience. A vertically integrated utility typically controls generation, transmission, and distribution, and is expected to have robust internal safeguards.
Nepra specifically cited violations of several regulations, including Section 14B(4) of the Nepra act, Rule 10(6) of the Nepra Licensing (Generation) Rules, 2000, and multiple clauses (OC 8.1.1,8.1.4, 8.2.1, 8.2.2, and 8.2.3) of the Grid Code. These violations relate to operational standards and grid stability maintenance.
The Rs25 Million Fine and Payment Terms
As a result of these findings, Nepra imposed a fine of Rs25 million on K-Electric, payable within 15 days of the notification. According to Nepra, failure to remit the fine within the stipulated timeframe will trigger recovery proceedings under Section 41 of the Nepra Act, read in conjunction with the Fine Regulations, 2021. This means Nepra will pursue the amount due as arrears of land revenue, a process that could involve legal action and asset seizure.
K-Electric’s Response
K-Electric responded to the penalty by calling it “surprising” in a statement released by a company spokesperson. The power utility indicated it is indeed currently reviewing Nepra’s detailed decision and will formulate a future course of action based on its assessment. As of October 9, 2024, K-Electric has not publicly announced its plans regarding the fine.
