Kejriwal’s Strategic Move: A Counter Tactic to BJP’s Maneuvers
Following Arvind Kejriwal’s resignation, Atishi Marlena, a prominent woman leader, has taken over as the new Chief Minister of Delhi. This change has sparked intense discussions, primarily driven by politics. The fact that Kejriwal, the undisputed leader of the Aam Aadmi Party, has been replaced by someone else marks a significant shift.
Over the past two years, the central government has made several attempts to jail Kejriwal and his close associates, including Sisodia, in various cases. Sisodia, the former Deputy Chief Minister of Delhi, was imprisoned for over a year and a half in the Delhi liquor policy case. He was granted bail when the central government lawyers failed to respond to the Supreme Court’s query regarding the case’s status.
In the case against Kejriwal, he was not arrested for two years, only to be arrested immediately after the elections were announced. The court strongly criticized this move and granted bail until the end of the elections. The case was taken up by the Enforcement Directorate (ED), which trapped Kejriwal by making one of the accused an apology witness. The defector was later inducted into the BJP, and his father-in-law was given a seat to contest from Punjab.
When the Supreme Court questioned the government lawyer, they responded by saying it was acceptable to use such tactics. The court issued a strong warning, stating that such tactics should not be allowed in the future. After the Supreme Court granted bail in the ED case, the Central Bureau of Investigation (CBI) stepped forward with its case. Kejriwal was again jailed in this case but has since been granted bail.
The Supreme Court criticized the CBI in this case, reiterating its 2013 observation that the CBI is a “caged parrot.” The court noted that the CBI’s primary duty is to protect the interests of the central government. The judgment suggests that the court wanted to relax the bail conditions in this case but decided to maintain the same conditions due to legal limitations.
The bail conditions include restrictions on Kejriwal’s movements and activities. He is not allowed to visit his office or sign files, except those to be submitted to the Lieutenant Governor. While some conditions, such as not discussing the case in public forums, have a legal basis, many legal experts question the validity of imposing such restrictions on a popularly elected Prime Minister who is out on bail.
Kejriwal’s resignation has been seen as a strategic move, allowing him to claim innocence to some extent. The Constitution states that in a democracy, the people are sovereign, and Kejriwal can now face the people’s trial. With the Delhi Assembly’s term ending in February next year, Kejriwal has demanded that the Delhi elections be held concurrently with the Maharashtra assembly elections in December.
The Aam Aadmi Party believes that this will provide an opportunity to prove their honesty before the people. As a state government, they have been able to implement various beneficial policies in areas such as electricity, water, health, and education. It is also believed that with the people’s support, the party can take on the BJP government more effectively.
Atishi Marlena, the new Chief Minister, is not a newcomer to politics. She has been handling the education and finance departments in Kejriwal’s cabinet and was a mentor to Manish Sisodia, who improved Delhi’s government education scene during the first Kejriwal cabinet. With Atishi at the helm, the administration is expected to run efficiently, allowing Kejriwal to focus on reaching out to the people full-time.
