Koh Kood: Thai Territory – Cambodia Talks on the Horizon
Prime Minister Pae Thongthan Shinawatra has confirmed that MOU44, the agreement concerning maritime boundaries between Thailand and Cambodia, has not yet been disadvantaged. She announced plans to establish a Joint Technical Committee (JTC) to discuss the matter with Cambodia in November. The Prime Minister emphasized that when discussing border issues, they will approach the council. She stated that Cambodia’s non-participation in UNCLOS is not an obstacle, clearly asserting that Koh Kood belongs to Thailand.
During an interview on November 8, 2024, at the National Institute of Defense Studies, Vibhavadi Rangsit Road, Prime Minister Pae Thongthan addressed pressure from the Palang Pracharath Party (PPC) to cancel MOU44 due to ongoing legal issues and its lack of parliamentary approval. She explained that while the agreement has not been formally presented to Parliament, they adhere to the principle of openness in negotiations. International discussions are crucial, she emphasized, as canceling MOU44 would have implications for international relations. She highlighted the importance of understanding the reasons behind any potential cancellation and engaging in thorough discussions.
The Prime Minister mentioned meeting with Cambodian leaders during the eighth leaders’ summit on economic cooperation in the Greater Mekong Subregion (GMS). She stated that no issues regarding MOU44 were raised during this meeting. She also noted that Cambodia expressed willingness to support Thailand, emphasizing the need for clear communication between the two nations.
Regarding potential obstacles due to Thailand’s membership in UNCLOS and Cambodia’s non-participation, Prime Minister Pae Thongthan stated that all negotiations must occur within the framework of this global convention. She clarified that there are no issues arising from this discrepancy as MOU44 clearly defines it as a mutual agreement between the two parties regarding boundary negotiation.
The Prime Minister confirmed that Thailand’s Navy recently released a social media clip asserting Koh Kood‘s belonging to Thailand, based on UNCLOS regulations. She stated that Cambodia acknowledges this and has not raised any objections regarding Koh Kood. She emphasized that the Cambodian side is focused on establishing the JTC and expediting negotiations.
When asked about potential delays in submarine benefit negotiations due to ongoing discussions, Prime Minister Pae Thongthan stressed the importance of clarity first to avoid future complications. She reiterated the need for open communication and a clear understanding between both parties to ensure a smooth negotiation process.
