PRAGUE (AP) — Korea Hydro & Nuclear Power (KHNP) and Westinghouse Electric Company resolved a long-standing dispute in January, potentially clearing the way for the construction of two new blocks at the Dukovany nuclear power plant in the Czech Republic. However, the agreement has drawn scrutiny and criticism in South Korea over its financial implications.
Terms of the Settlement
Under the agreement, KHNP will pay Westinghouse $150 million for fees related to the use of its APR reactor technology, according to the Korean news outlet Pulse. Additionally, KHNP would reportedly provide the U.S. company with $800 million for every project that utilizes the exported nuclear technology. Sources within KHNP have confirmed these details.
Dispute Origins
The core of the dispute centered on reactor technology jointly developed by both companies years ago. Westinghouse originally sold the technology to KHNP for exclusive use in Korea. Over time,KHNP modified and improved the technology,leading to disagreements over intellectual property rights,specifically concerning the APR1400 reactor technology,a version of which (APR1000) is slated for use in the Czech Republic.
Westinghouse viewed the use of this technology outside Korea without their explicit consent as a violation of their patents. The agreement now stipulates that KHNP requires U.S. government consent to use the technology abroad.

The Czech Ministry of Industry and Trade (MIT) views the settlement positively, seeing it as a crucial step toward the Dukovany project.”The agreement between KHNP and Westinghouse is crucial for the Dukovany project, eliminating the possible risk of disputes between KHNP and Westinghouse, so we welcome this agreement,” said David Nektoštík, a representative for MIT.
Korean Concerns
Despite the resolution, concerns linger in Korea that KHNP made excessive concessions to Westinghouse.Critics suggest these concessions could hinder long-term exports of korean nuclear technologies, potentially limiting successes to short-term projects like the Czech nuclear power plant.
The agreement is expected to result in lower profitability from foreign nuclear projects and reduced incentives for trades that do not include the $800 million and $150 million provisions.
Financial Breakdown
the construction of one reactor in the Czech Republic is estimated to cost CZK 200 billion ($9.05 billion). Westinghouse stands to gain approximately nine percent of this contract, with an additional 1.7 percent allocated for license fees.
Past Precedent
A similar situation occurred with the Barakah nuclear power plant in the united Arab Emirates, completed by the Koreans in 2019. To resolve intellectual property concerns, the companies agreed that Westinghouse would supply key components, including pumps, reactor cooling media, and turbines.
The Barakah power plant project reached $18.6 billion, with Westinghouse receiving approximately $2 billion in supplies.
KHNP’s Perspective
KHNP has refuted some of the information circulating, stating that the agreement, finalized on January 16, 2025, aims to end the dispute and foster cooperation in the global nuclear market. The company maintains that some details in earlier reports are inaccurate.
KHNP also agreed that Westinghouse would supply fuel rods for future export projects, representing approximately six to seven percent of the order value.
A KHNP representative acknowledged the concessions made regarding intellectual property fees and guaranteed trades but emphasized the considerable benefits gained from Westinghouse in return. due to a confidentiality agreement, specific details cannot be disclosed.
Government Stance
The Korean Ministry of Commerce, Industry and Energy echoed this sentiment, stating that while specific details remain confidential, the contract is “by no means disadvantageous” overall.
Future Implications
The agreement between KHNP and Westinghouse aims to facilitate cooperation on new nuclear projects worldwide. However, KHNP has reportedly withdrawn from three nuclear projects in Europe since the beginning of the year, including projects in Sweden.
