IBP Defends Judicial Review in Impeachment, Warns Against Defiance
MANILA, Philippines – The Integrated Bar of the Philippines (IBP), the nation’s largest organization of lawyers, has firmly asserted the Supreme Court’s pivotal role in interpreting constitutional limits, even in politically charged matters such as impeachment proceedings. The organization issued a strong statement defending the rule of law and cautioning against public defiance of judicial rulings.
Upholding the Rule of Law
The IBP emphasized that the Supreme Court, as the final arbiter of constitutional questions, has the authority to determine the boundaries of impeachment. This stance, they clarified, does not diminish the exclusive power of the House of Representatives but rather dignifies it by ensuring it operates within constitutional parameters.
“The rule of law is a legal order that binds those who govern and empowers the governed. We defend that order,” the IBP declared in its statement.
Impeachment Beyond Political Vacuum
While acknowledging impeachment as a crucial tool entrusted to elected representatives, the IBP stressed that it cannot operate in isolation from constitutional scrutiny. “Its political nature does not place it beyond the reach of judicial review,” the group asserted, highlighting that the Supreme Court’s interpretation ensures accountability and adherence to the fundamental law of the land.
Warning Against Disregard for judicial Authority
The IBP issued a stern warning against any attempts to incite public defiance of the Supreme Court’s decisions, labeling such actions as a “dangerous erosion of legal order.” The organization stated that while disagreement wiht the Court’s reasoning is a legitimate part of democracy, calling for outright repudiation of its authority undermines the very foundations of the nation’s legal institutions.
“Every adverse ruling cannot become an invitation to disobey. The law must not become the first casualty of dissent,” the IBP cautioned.
the statement also implicitly criticized leaders and institutions that might bypass legal remedies in favor of populist sentiment,particularly when established legal avenues are available. “Especially when appropriate legal remedies remain available within the framework of our constitutional system,” the IBP emphasized.
