Attorney Charlotte Tibana and her husband, Tshwane Metro Police Department officer Peter Nonyane, remain in custody after the Limpopo High Court in Polokwane dismissed their bail appeal on October 22, 2026. The couple faces 123 charges, including theft, fraud, and money laundering, stemming from an alleged R11 million scheme involving 15 deceased estates where Tibana served as executor, iol.co.za reported.
Limpopo High Court Dismisses Bail Appeal for Attorney and Metro Police Officer
Judge Carrim Pillay confirmed the Polokwane Magistrate’s Court decision to deny bail, rejecting arguments that Magistrate Godfrey Netshiozwi had overlooked the couple’s personal circumstances or failed to consider house arrest and electronic monitoring, Sowetan reported. The appeal was heard virtually on October 21, 2026, before the ruling was handed down in open court the following day. National Prosecuting Authority spokesperson Mashudu Malabi confirmed the outcome.
According to Sowetan, Judge Pillay described the couple’s belief that the criminal allegations could be resolved through financial negotiations or repayment as misguided,
emphasizing that returning funds does not erase potential criminal liability. The court found that Tibana and Nonyane failed to prove that the interests of justice favored their release.
State Allegations Involve Deceased Estate Funds and Luxury Purchases
Prosecutors allege that the pair unlawfully withdrew and laundered approximately R11 million from accounts tied to 15 deceased estates, according to iol.co.za. The State maintains that about R1.65 million of the allegedly illicit proceeds was used to purchase a pre-owned Mercedes-Benz AMG G63 from a Pretoria dealership, TimesLIVE reported.

Investigators also claim that Nonyane, widely known as Gagash, used a portion of the funds to make stokvel contributions and finance the construction of a residential property, as reported by iol.co.za. EWN noted that prosecutors successfully argued that releasing the couple could jeopardize ongoing investigations and put witnesses at risk of interference.
Co-Accused Granted Bail as Investigation Continues
While Tibana and Nonyane remain behind bars, two co-accused individuals secured release on bail on October 8, 2026. Rirhandzu Tibana, Charlotte Tibana’s younger sister, and businessman Jabulani Nephtal Maluleke were each granted R60,000 bail by the Polokwane Magistrate’s Court after the State chose not to oppose their release, according to TimesLIVE.

Sowetan reported that the State alleges Charlotte Tibana registered several properties under her sister’s name to conceal criminal proceeds, while Maluleke’s business account was allegedly used to launder money. As part of their bail conditions, Rirhandzu Tibana must report to the Letsitele Police Station every Friday, and Maluleke must report to the Pretoria Police Station during the same hours, iol.co.za stated.
Scheduled Court Appearance Set for November 2026
The criminal case against all four co-accused has been postponed to November 6, 2026, to allow for further police investigations, according to iol.co.za. Charlotte Tibana and Peter Nonyane will remain in custody pending that upcoming court appearance.
