Table of Contents
South African solar panel manufacturer ARTsolar secured a key legal victory on January 17, 2026, compelling the government to release records related to alleged failures to enforce local content requirements in renewable energy contracts.
What is the Dispute About?
ARTsolar, the only solar panel manufacturer in Sub-Saharan Africa, alleges that 18 foreign companies and their joint ventures have not fulfilled the local content obligations stipulated in their contracts for renewable energy projects. The company claims these independent power producers (IPPs) systematically avoided procuring locally manufactured solar panels.
When Did ARTsolar Take Legal Action?
ARTsolar initiated its main review application in 2024, seeking a court order declaring the non-compliance of the IPPs with the local content requirements. The application names 27 respondents.
What Did the Court Order?
Acting Judge John Mullins of the pretoria High Court ordered the Department of Mineral Resources and Energy (DMRE) to produce the complete record of decisions concerning the mandatory local content requirements for the tenders. This order came despite opposition from some respondents who argued the information was commercially sensitive. The judge acknowledged the potential for disclosing confidential bidder information but deemed the record’s production necessary for the review application.
What is at Stake?
The case centers on the enforcement of local content regulations within multibillion-rand renewable energy contracts. ARTsolar argues that adherence to these regulations is crucial for developing South Africa’s domestic manufacturing capacity and creating jobs. The DMRE has not yet publicly commented on the court order as of January 18, 2026.
