Mahmoud khalil’s Detention Sparks Debate Over First Amendment Rights

The ongoing detention of Mahmoud khalil, a Columbia University student protest leader, has ignited a debate over First Amendment rights and immigration enforcement. Khalil’s case gained prominence after being mentioned in a New York City mayoral debate.
Zohran Mamdani, a Democratic Socialist mayoral candidate, condemned Khalil’s detention, calling it an “abomination” and an attack on the First Amendment. Mamdani also accused former president Donald Trump of weaponizing antisemitism to target Palestinian New Yorkers.
Former New York Gov. Andrew Cuomo echoed Mamdani’s sentiments, stating that Khalil should be released.This marks a shift from Cuomo’s earlier response in March, when he criticized what he termed antisemitic agitators at Columbia.
Baher Azmy, legal director for the center for constitutional Rights and part of Khalil’s legal team, highlighted that Khalil was apprehended by ICE officers in front of his than-pregnant wife and transported to a detention facility in Louisiana. Azmy said that they are challenging the legality of Khalil’s detention in both immigration court and federal court.
According to azmy, the Department of Homeland Security initially sought to deport Khalil based on a determination by secretary of state Rubio that his presence in the U.S. would be adverse to foreign policy interests. When that claim faltered, Azmy said, the department added charges of misrepresentation on his application. Azmy contends that the misrepresentation claim has been largely abandoned due to its factual implausibility.
in federal court in new Jersey, Khalil’s legal team is challenging the constitutionality of the rubio determination, arguing it violates the First Amendment and due process rights. A district court judge has indicated that the rubio determination is highly likely unconstitutional due to its vagueness.
