Rose Hill, Kilkenny – A man who allegedly occupied a house in Kilkenny and collected rent from tenants despite the property being sold at auction could face imprisonment for contempt of court.
David Walshe is accused of unlawfully occupying the terraced house on Manor Walk,Rose Hill,even after it was purchased by Adrian fox,a garage owner from Naas,Co. kildare, for €170,000 in August 2023. The property was sold by Everyday Finance DAC, which had acquired it in 2019 due to a mortgage default by a previous owner unrelated to the current dispute.Fox claims that when the property was listed for sale, a demand was made for Walshe to be paid €146,000 for his alleged interest in the property. Walshe has also been featured in social media videos offering legal advice on mortgage issues, according to Fox.Fox sought a court order for possession of the property against Walshe and any other occupants. On Friday, two men who admitted to paying Walshe between €450 and €500 per month in rent were brought before the High Court by gardaí.
Solicitor Ruaidhri Giblin, representing Fox, requested attachment and committal orders against Walshe and others, meaning they could be arrested and brought to court to explain why they shouldn’t be imprisoned for contempt.
The two men stated they had received court orders to vacate the property on November 29th and understood the implications. One man said he was seeking legal advice, while the other explained he had been actively searching for choice accommodation and had spent three days “on the street” before finding a new place.
The case is expected to continue next week, with Walshe potentially facing serious consequences for his alleged actions.
