Former Congressman Sued Over Alleged Misuse of Trade Information in Guyana Fuel Deal

A lawsuit filed in Florida alleges that former U.S. Representative Mark Green and lobbyist Marc C. Hebert improperly used confidential business information while pursuing a fuel supply agreement with the government of Guyana. The suit, brought by Curlew Mainstream LLC and Playera Group Global LLC, claims the pair leveraged privileged information to compete with the companies for a lucrative contract.

According to the lawsuit, Hebert previously represented Playera as it collaborated with Curlew to secure a fuel supply arrangement with Guyana. The plaintiffs allege that Hebert then used confidential information obtained during that representation to establish a competing venture with Green, ultimately forming a company called Prosimos.

Green established Prosimos alongside Hebert last spring, shortly before announcing his abrupt retirement from Congress in June 2026. His departure came less than six months into his fourth term, a campaign marked by personal challenges including a divorce and reported tensions within his family. He officially stepped down in July, triggering a special election to fill his seat.

During the campaign to replace him, Green told the Nashville Banner that Prosimos was intended to compete with Chinese companies for international business opportunities, stating, “The motto is basically, ‘If an American company doesn’t do it, a Chinese company will.’” He added, “Why not help American companies go overseas — I’ll make a little bit of money doing it, OK, it’s a for-profit entity — but I’m not taking the U.S. Flag out of my rucksack, right?”

Guyana has become a focal point for international interest since the discovery of significant oil reserves off its coast in 2015. The country now faces competition from larger nations seeking to profit from its resources and the infrastructure needed to extract them.

The lawsuit further alleges that Green and Hebert, while Green was still chairman of the House Homeland Security Committee, suggested they could influence whether Curlew Midstream would secure the fuel exchange agreement during a meeting in Washington, D.C. In April 2025. Later that week, Prosimos was registered in Florida, and the pair reportedly communicated with the Guyanese government regarding alleged issues with Curlew’s pending agreement, actions the plaintiffs claim delayed the deal.

The plaintiffs claim that as recently as January 2026, Curlew was still engaged in discussions with the Guyanese government to resolve outstanding issues hindering the original fuel agreement. Around that time, Green reportedly traveled to Guyana again to negotiate a similar fuel deal.

According to the lawsuit, the Guyanese government then presented Curlew with a signable agreement in mid-January containing “last-minute” changes, including the involvement of an unnamed consultant. The plaintiffs allege that the Guyanese government did not initiate these changes.

As of March 7, 2026, the defendants have not filed a response to the lawsuit. Attempts to reach Green for comment were unsuccessful. Neither the attorneys for the plaintiffs nor Hebert’s office responded to requests for comment.
