Lindsey Hull stated that her parents were arrested based on warrants ⁢issued​ in Mexico following​ a criminal complaint⁢ filed by “The Palace Company”⁣ for alleged fraud. We assume that it has something to do with the timeshare with Palace Resorts, she recalled her stepfather telling her during a phone⁤ call after‌ the arrest.

Prosecutors in Quintana Roo, the Mexican‌ state⁣ where‍ Cancun is located, stated that the‌ couple canceled 13 credit card payments to a hotel chain in 2022, totaling over $116,500. While prosecutors did not provide further details, they assert⁣ that this activity ⁢constitutes fraud.

According to the Akeo family’s lawyer, ‌John⁣ Manly, the⁤ case‍ stems from ⁤a 2021 timeshare agreement between the Akeos and ⁢Palace Elite,⁤ a‌ subsidiary ​of The Palace Company.

The Akeos claim that after a ⁣few months, ⁢Palace breached the promised ‍services. ⁢Later,they filed ​a complaint with their⁣ credit card⁤ company,seeking reimbursement of nearly $117,000 ‍in payments made ‍to Palace,arguing that the resort company ‍failed to fulfill its contractual obligations.

The‍ Akeos are arrested becuase they successfully disputed Palace’s‌ positions and lack of ⁣provision⁢ of services with American⁢ Express, criticized the company ​on Facebook, and alerted others who felt⁤ harmed ⁣by ⁤Palace, Manly said in a statement.

Prosecutors allege⁣ that Christy Akeo ⁣used Facebook to⁤ share‍ facts about⁤ the ‍alleged fraud committed by the hotel‍ chain. ⁤Manly contends that the company is retaliating against the couple for challenging the charges.

In ‍a letter, ⁢Manly stated⁣ that the company ⁢is extorting the couple ⁣and their family and taking reprisals against them for‍ challenging fraudulent and illegal ‍charges and then publishing their experience ⁢in social networks.

Manly wrote, To put it clearly, in retaliation, their ‌clients captured, kidnapped, mistreated, ⁣assaulted, unjustly imprisoned, threatened,⁤ intimidated, belittled, harassed, defamed and participated in such a horrendous and scandalous civil and criminal ⁣conduct against these two ‌American elders who are almost incomprehensible.

Manly warned in the letter that the case could have negative consequences for ‍tourism in the region. The couple’s arrest has⁣ generated suspicion between at least another ⁤couple when traveling to ‍Mexico.

Jenn Bartko,⁤ 52, said that she and her husband do not plan to go to Mexico soon for ‍fear of being arrested after seeing what happened to the Akeo. Like the ‍Akeo,‍ the credit card company reimbursed US $ 8,355 of the ‌Palace Elite Resorts last‌ week, Bartko⁤ declared.

I‍ just want more‌ people to be aware ⁢of the ‌scam,‌ and⁣ you have to stop​ this company, ​Bartko​ said. It is not fair for those⁣ who were⁢ going to‍ have a ⁣good ‌vacation,‍ and this experience ⁤entirely ruined⁢ our vacations.

Bartko said⁢ she and⁣ her husband ⁣made a deposit for⁣ a Palace Elite membership during her stay ​at the Moon Palace Cancun⁢ in mid‌ -January, but soon realized that many of the promised membership offers ‍did ​not exist and found negative criticism online, ⁤she said.

Although they ⁤were still within the five -day grace period, the staff refused ‌to give them​ a complete refund and waited until they returned home in San Diego to dispute the charges with their‌ credit card ⁣company, Bartko said.

Bartko said‌ they involved Profeco, the‍ Mexico consumer protection agency, where ‌appropriate. Palace Company ​did not​ respond to the request to comment on the more ‌than 100 complaints filed against him​ before‍ the consumer protection agency.

We will not go to Mexico for a while, which is sad because we⁢ are right on the border with Mexico. we⁢ love Mexico, Bartko said. I am not willing to try​ to find out because ‌I don’t want to get caught‍ in a Mexican prison.
