New Taipei City Councilor Huang Junzhe was accused of buying 456 boxes of Lin Chongming’s Casserole Fish Head gift boxes during the 4th New Taipei City Council Election in 2011 and giving 43 of them to voters. Huang Junzhe’s election was prosecuted by the New Taipei District Prosecutor’s Office. The New Taipei District Court ruled to overturn the ruling that prosecutors appealed in the second instance.

Huang Junzhe’s father, Huang Zhongxin, head of Jin Zhanran Construction Company, said in September this year that he paid 20 million yuan in the company’s name to Huang Junzhe to run for re-election. After instructions from Lin Huang Junzhe’s father of Jin Zhanran Construction Company, Deputy General Manager Huang Junzhe wanted to buy 1,000 boxes of fish head casserole gift boxes to send to voters in the constituency, because the quantity was too large and difficult to accumulate and save, he changed the price to 500 boxes. , with a total cost of more than 290,000 yuan.

After Jin Zhanran Construction Company ordered gift boxes, they sent them to the company, and after competition manager Huang Junzhe received 456 gift boxes, he ordered 5 members of the competition management team to distribute them to 43 districts. In exchange for the votes of the chief and the residents within his jurisdiction.

The New Taipei Prosecutor’s Office prosecuted Huang Zhongxin, Tang Longhui and others on suspicion of election bribery and filed a case against Huang Junzhe to have his election annulled. After the trial, the New Taipei District Court determined that the evidence presented by the prosecution was not sufficient to prove that the defendant Huang Junzhe personally sought unfair advantage from the franchise holders in exchange for certain exercise of the franchise, or that this was a motive. Bribery law therefore, the prosecution that Fang lost the case and the prosecutor appealed the second instance.

The collegial bench of the High Court said Tang Longzhui, the director of Huang Junzhe’s office, appointed Huang Junzhe’s service office secretary and volunteers to give gift boxes of fish head casserole since Huang Junzhe benefited from the services provided by his service staff. Office, he must be responsible for his service office, and responsible for their actions Huang Zhongxin and the delivery of gift boxes should therefore be regarded as Huang Junzhe’s actions. The prosecutor argued that Huang Junzhe’s election was illegal and the first trial was annulled to invalidate Huang Junzhe’s election.
