NAACP Targets Elon Musk’s xAI Over Memphis Air Pollution

The NAACP is preparing to sue Elon Musk’s AI company, xAI, alleging that its Memphis data center is violating federal law and harming the environment through air pollution. The civil rights institution, represented by the Southern Environmental Law Center (SELC), sent a notice tuesday signaling its intent to sue.
At issue are methane gas turbines used to power the South Memphis facility. The SELC alleges that xAI is operating these turbines without securing necessary permits or implementing “best available” pollution controls. Data centers, crucial for AI computing power, consume vast amounts of electricity, frequently enough relying on fossil fuels like natural gas due to the slow adoption of clean energy alternatives.
Methane, while short-lived in the atmosphere, is a potent greenhouse gas. The SELC contends that emissions from xAI’s data center exacerbate existing air quality problems in Memphis. The organization stated that in April, nearly all of the 35 turbines installed by the AI company were running without the required permits. While some smaller turbines have been removed,three larger ones were recently installed,the SELC said.
In August, the SELC reported that xAI had installed 20 gas turbines at the Memphis site.
“These turbines have pumped out pollution that threatens the health of Memphis families. this notice paves the way for a lawsuit that can hold xAI accountable for its unlawful refusal to get permits for its gas turbines,” said SELC Senior Attorney Patrick Anderson.
An xAI spokesman responded that the company is committed to the community and environment, and that the temporary power generation units are operating in compliance with all applicable laws.
