Nevada Court Temporarily Blocks Polymarket, Citing Gambling Law Concerns

February 4, 2026 – A Nevada state court has issued a two-week temporary restraining order against Blockratize, the operator of the prediction market Polymarket, preventing the company from offering sports and event contracts to residents of Nevada. The ruling, delivered by a judge, stems from a civil complaint filed by the Nevada Gaming Control Board, which alleges that Polymarket is operating in violation of state gambling laws.

The court agreed with the Gaming Control Board’s assessment that Polymarket is operating without a required state gaming license. The judge also determined that the federal Commodity Exchange Act does not grant the Commodity Futures Trading Commission (CFTC) exclusive authority over these types of contracts, opening the door for state-level regulation.

This action marks a significant challenge for Polymarket, which allows users to trade on the outcomes of real-world events using cryptocurrency. The temporary restraining order specifically targets the platform’s sports and event contracts, effectively halting those offerings within Nevada for the duration of the order.

The implications of this ruling extend beyond Nevada. According to reports, if the restraining order is upheld, Polymarket and similar platforms may be compelled to obtain state gaming licenses in order to continue offering these types of markets. Alternatively, they may be forced to cease operations altogether in states pursuing similar legal challenges.

The legal action in Nevada is part of a broader trend of increased regulatory scrutiny surrounding prediction markets. Polymarket has recently faced bans in Portugal and Hungary, with regulators citing concerns about illegal gambling activity and unauthorized betting on political events. These actions in Europe add to the pressure on the platform as it navigates a complex and evolving regulatory landscape.

In 2022, the CFTC imposed a $1.4 million penalty on Polymarket, requiring the platform to return to U.S. Oversight. This followed concerns about betting and potential insider trading risks. More recently, a $436,000 trade related to the potential removal of Nicolás Maduro prompted a draft bill from Rep. Ritchie Torres, highlighting growing anxieties about the integrity of these markets.

The situation is further complicated by concerns surrounding political betting and the potential for insider trading. The platform’s volume has grown significantly, reaching $13.5 billion with 43 million transactions monthly, according to reports, raising the stakes for regulators.

As of February 4, 2026, Polymarket is attempting a controlled return to the American market under CFTC oversight, but faces mounting hurdles from state and international regulators. The core debate centers on whether these markets represent legitimate financial innovation or constitute unlicensed gambling.
