Oklahoma Family Files Lawsuit in​ Noah Presgrove Death Examination

the family of⁤ Noah Presgrove, 19, who was found ⁤dead along U.S. 81 in Oklahoma on sept. 4,2023,has filed⁣ a wrongful​ death lawsuit. The lawsuit comes nearly two years after⁣ Presgrove’s mysterious death following a Labor Day weekend party. He​ was discovered wearing only mismatched shoes, with blunt-force ⁢injuries.

Despite an ongoing investigation by state police into⁣ the death, which some speculated may have been ​a hit-and-run, no car parts were found ‍at the scene. Ryan ⁣Sailors, the⁢ family’s attorney, said the‍ lawsuit ‌aims to uncover information from those who ‍attended the party.

The wrongful death lawsuit names four of Presgrove’s friends who were at the party as‌ defendants.Sailors ‍alleges that at least two of them conspired to inflict the injuries that led ‍to Presgrove’s death. The suit⁣ also​ names a friend’s father,​ the ‌property owners where the party occurred, and​ the store ⁢that allegedly sold ‌alcohol to minors.

Sailors⁤ said it remains unclear whether Presgrove’s body was dumped or‌ if⁤ he wandered away with ‌severe injuries before collapsing. “Given ⁢the nature of‍ how⁢ his⁤ body was ⁢found… the running theory is it might have been dumped along the highway,” Sailors said.

The​ lawsuit seeks​ at least $75,000 ⁣in damages for funeral⁢ costs, pain and ‍suffering, ​lost earnings, and punitive damages. Sailors argues that providing alcohol to Presgrove and his attendance at the party ⁢contributed to his death. “If Noah would⁤ not ⁤have been provided that⁢ alcohol, if Noah ⁣would not have ‍been in attendance at this ​party, it is very likely ⁤Noah would‍ still be ​here today,” ‍Sailors said.

The Oklahoma State ⁣Bureau of ​Investigation ‌initially deemed ​Presgrove’s ‌death “suspicious.” However,the Highway Patrol⁢ is not investigating it as a​ murder. A medical examiner’s​ report ​indicated Presgrove died from ‍”multiple blunt force injuries,” with the manner of​ death listed⁤ as⁣ “undetermined.” The report noted various injuries and‍ abrasions, including a caved-in skull and road⁢ rash.

The medical examiner’s ‍report also revealed ⁢that Presgrove’s blood alcohol level was 0.14 at​ the time of the autopsy. “At this time, what transpired on how the body was found on the road having multiple blunt ​force injuries is unknown,” the report stated.
