North Dakota Insurance Fund Criticized for Claim Denials

North Dakota Insurance Fund Criticized for Claim Denials

December 9, 2024 Catherine Williams - Chief Editor News

North Dakota Insurance ⁣Fund‌ Under Fire for Denying Claims Without Clarification

Bismarck, ND – A scathing ⁤audit report presented to North Dakota legislators last ‍week has revealed a troubling pattern of claim denials ⁣by the North⁢ Dakota Insurance Reserve‌ Fund ⁤(NDIRF), the state-run insurer for local governments. The report, ‌which examined a sample of ⁤299 claims filed between February 2019 and January 2024, found that the NDIRF routinely denied claims without providing adequate explanation or documentation, ‌leaving residents‌ frustrated and feeling‍ unheard.“This is government at its‍ worst,” declared Rep. Austen Schauer, R-West Fargo, ⁤during a hearing of ‍the interim‌ Legislative Audit and Fiscal Review Committee. ‍

The audit, presented by Deputy Insurance Commissioner John⁣ Arnold, highlighted several concerning issues. ⁤ ⁣A significant percentage of third-party claims – those involving ‍individuals or businesses not directly covered by ⁤the NDIRF – were closed without payment.

“Overall during the period, ⁤in third-party claims… 71.5% were closed without payment,” the report stated.

Further ⁢fueling the outrage, the audit found that many claim files lacked essential documentation, such as damage estimates, photographs, and police reports, raising questions about the thoroughness of the NDIRF’s investigations.

“In some files, there was no ‍documentation reflecting any form of investigation,” the report noted.

Keith Pic, CEO of the NDIRF, defended the insurer’s practices, arguing that the burden of proof⁤ lies with the claimant⁤ to demonstrate ⁤the government ‍entity’s fault. He also suggested that additional documentation might be redundant.

Though, ⁤legislators remained unconvinced. ⁢Rep. Mike Nathe, R-Bismarck, criticized the NDIRF’s customer service, stating, “The customer service is extremely ⁢poor. You’re not informing ⁤the claimant at all, and it’s just enraging people.”

Marc Montplaisir, a Mandan resident whose property was damaged ⁤by a broken fire hydrant, shared his experience with the committee. His claim, along with those of his neighbors, was denied by the⁢ NDIRF.

“It made my blood boil even more,” Montplaisir said, urging legislators to delve‌ deeper into the insurer’s practices.

The audit report recommended several improvements, including the creation ‌of checklists for adjusters, a standardized ‍policy for handling claims, and mandatory supervisor⁣ review of claim files before closure.

Legislators expressed concern over the lack of ⁤oversight and transparency. Rep. Emily O’Brien, R-grand Forks, chair of the committee, suggested that the Legislature may need to take a‍ more active role in overseeing the ‍NDIRF.

Rep. Schauer went further, calling the NDIRF’s actions “nearly criminal” and advocating for its dissolution.

While some legislators, like Rep. Scott Wagner, R-Fargo, acknowledged the NDIRF’s positive ‌contributions, such⁣ as safety training and risk management advice for local governments, the overwhelming sentiment was one of alarm and a call for immediate action to address the insurer’s ‌shortcomings.

The future of the NDIRF hangs ‌in the balance⁤ as legislators grapple with the findings of the audit and consider potential reforms to ensure that north Dakota residents receive fair and obvious treatment when ⁢filing claims.

NDIRF Under Scrutiny ‍as⁢ audit Reveals Troubling Claim Denial practices

bismarck, ND ‍-‌ Teh North Dakota Insurance Reserve Fund (NDIRF), the state-run insurer for local governments, is facing intense scrutiny following⁢ a damning⁤ audit report ⁣presented to state⁤ legislators ‌last⁤ week. The report, which analyzed a sample of 299 claims filed ‍between February 2019 and january 2024, unveiled a systemic pattern of claim denials characterized⁣ by inadequate explanation and lack of documentation, leaving residents feeling‍ frustrated and disempowered.

I sat down with Sarah Miller, a consumer rights advocate and insurance policy⁢ expert, to discuss the implications of ‌this audit and ⁢what it means for North⁤ Dakotans.

NewsDirectory3: Ms.Miller, the audit paints⁢ a grim picture‌ of the NDIRF’s claim handling‍ practices. What are your initial ‌thoughts?

Sarah Miller: This⁤ report is deeply disturbing. ⁤State-run‍ entities ‌like the NDIRF have a unique responsibility to be clear ⁢and‌ accountable to the public they serve. Denying claims⁤ without proper justification ‍erodes public trust and creates meaningful hardship ⁣for individuals and communities relying on this insurance coverage.

NewsDirectory3: The audit mentions a⁣ lack of clarity and ‌documentation surrounding denied claims. How‌ significant is this issue?

Sarah Miller: It’s crucial. When a claim is ⁤denied, individuals deserve a clear explanation outlining the reasons behind the decision. Without proper documentation, it becomes nearly⁣ impractical for⁢ claimants to understand why their claim was rejected and to challenge the ‍decision if they believe it’s unfair.

NewsDirectory3: Rep. ‌Austen ‌Schauer called ⁤this “government at its worst.” Do you ‌agree?

Sarah miller: While I⁢ hesitate to use⁣ such strongly worded language, I believe his sentiment reflects the gravity of the situation.‌ This isn’t just about financial losses for individuals;⁤ it’s about the erosion of public trust in‌ a vital institution.

NewsDirectory3: What steps should ‌be taken to address these issues?

Sarah Miller: The⁣ NDIRF needs to⁣ immediately‌ implement comprehensive reforms to⁣ its claim processing practices. This includes:

Mandating⁤ detailed explanations for denials: Every denial must include a clear and concise explanation of the specific reasons behind the ‌decision, citing relevant policy provisions.

Providing accessible and comprehensive documentation: Claimants should have access to all ‌documentation‍ related to their claim, allowing ⁣them to fully understand the decision-making process.

Establishing ‍an independent review mechanism: An ⁢independent body should be established to review denied claims and ensure fairness and transparency.

increasing public oversight⁣ and‍ accountability: Regular audits and public hearings should⁢ be conducted to ensure ‍the NDIRF remains accountable to the public‌ it serves.

NewsDirectory3: What message should this send ⁣to North Dakotans who rely on the NDIRF for coverage?

Sarah Miller: This ⁤report should serve as a wake-up ⁤call. North Dakotans deserve better. They should know their rights, understand the claims process, ⁣and be prepared to advocate for themselves if their claims are unfairly ⁣denied. It’s essential ⁢to push for greater transparency and accountability from the NDIRF to ensure they fulfill ‍their core responsibility of ⁣providing fair and reliable‍ insurance coverage to the communities they serve.
