NY Extends CDPAP Registration Deadline Amid Legal Action
Caregivers in New York’s Consumer Directed personal Assistance Program (CDPAP) have been granted another extension to complete their registration wiht Public Partnerships LLC (PPL),the state’s single fiscal intermediary for the self-directed Medicaid home care program. The new deadline is July 1.
U.S. District Court Judge Frederic Block issued the extension Thursday. It enables caregivers to continue receiving payment through their previous fiscal intermediary while finalizing registration with PPL.The move comes amid ongoing legal challenges to the transition.
The New York Legal Assistance Group (NYLAG) and law firm Patterson Belknap Webb & Tyler LLP initiated a class action lawsuit in March on behalf of CDPAP consumers. In May, they filed a pre-motion letter requesting court intervention, seeking an extension to Aug. 15. the court initially granted a deadline of June 20.
The New York State Department of Health selected PPL, based in Alpharetta, Ga., as the single fiscal intermediary in October. The original registration deadline of April 1 has been repeatedly pushed back due to complications.
NYLAG reported that on June 26, the Department of Health and the plaintiffs will jointly submit a proposed preliminary injunction, seeking its continuation untill the case concludes. A final settlement agreement will follow, with a fairness hearing allowing class members to voice objections. Another hearing, anticipated in August, will address feedback before the judge’s final decision.
“We hope that this settlement will benefit CDPAP Consumers who still need help accessing long-term care services,” NYLAG said.
