Ohio Father Sues Nationwide Children’s Hospital After Infant’s Death
Columbus, – A father from Zanesville, Ohio, has filed a wrongful death lawsuit against Nationwide Children’s Hospital following the death of his 27-day-old daughter, Ellieana Peyton. The lawsuit alleges negligence contributed to Ellieana’s death after she fell from her crib while hospitalized in March 2025.
Tyler Peyton filed the lawsuit in Franklin County Common Pleas Court on , according to reports. The suit claims that a patient care assistant left a rail down on Ellieana’s crib while monitoring wires remained connected to the infant and to a device in the assistant’s pocket. When the assistant moved away from the crib, the wires reportedly pulled Ellieana, causing her to fall approximately three to four feet to the floor.
Ellieana was born on , at Nationwide Children’s Hospital and was immediately admitted to the Cardiothoracic Intensive Care Unit (CTICU) due to a diagnosis of congenital dilated cardiomyopathy, a heart condition that can affect the heart’s ability to pump effectively. For several weeks, hospital staff monitored Ellieana and she was reportedly stable enough to be discharged on or around .
Following the fall on , a CT scan revealed Ellieana suffered a skull fracture and brain bleeding, as well as bruising and tenderness at the impact site. Her vital signs subsequently deteriorated, with reports indicating low blood pressure, a rapid heartbeat, and decreased blood oxygen levels. Her heart function continued to decline, and she died on the evening of .
An autopsy determined that Ellieana died from a congenital heart defect complicated by the head injury sustained in the fall, according to the lawsuit. The lawsuit further alleges that Ellieana was “pulled from her unsecured crib at Nationwide Children’s Hospital by attached wires.”
Nationwide Children’s Hospital has stated that it cannot comment on pending litigation. No other defendants are named in the lawsuit filed by Tyler Peyton, acting as the administrator of his daughter’s estate.
According to court records, the incident occurred around 9:30 p.m. On . Prior to the incident, hospital staff had documented that Ellieana was tolerating feeds, showing normal neurological examinations, and maintaining normal or near-normal heart function.
