The core ‌of the​ dispute revolves around post-production costs. Oil⁤ companies argue they can deduct expenses like transportation, processing, and marketing from the ⁣royalties paid to landowners. Landowners,however,contend these deductions unfairly‍ diminish their share of the profits.

### The Skarphol’s Case and a History of Legal Challenges

The Skarphols took Hess Corporation to court, hoping to‍ challenge the deductions. Northwest Judicial District​ Judge Robin Schmidt ruled against them, citing North dakota law. She ⁤acknowledged the Skarphols’ long-standing ⁤request for the Legislature to change⁤ the law, but stated, “is not on ⁣your side.”

This isn’t an isolated incident.The North Dakota Supreme Court ‍has previously overturned ​Judge Schmidt’s rulings in a similar case concerning deductions, adding another layer of complexity. the Skarphols’ attorney anticipates an appeal, and the judge even suggested they could pursue a new lawsuit regarding different oil wells.

Currently, Hess is‌ deducting 36% of the Skarphol’s royalties this ‌year alone. They, like many other landowners, are left to meticulously calculate their losses each month, hoping for a more favorable outcome.
