The Grand Chamber of the European Court of Human Rights delivered a landmark judgment in the case of Turkish human rights defender Osman Kavala, ruling that he has been unlawfully imprisoned for nearly nine years in a politically motivated trial. According to the court, Kavala’s criminal conviction must be considered null and void, and the panel ordered his immediate release while denouncing the bad faith of Türkiye’s authorities.
European Court Orders Immediate Release
More Than 3,000 Days Behind Bars
Osman Kavala has been deprived of his liberty since October 2017, spending over 3,000 days behind bars after initially being detained in connection with the 2013 Gezi Park protests in Istanbul. Alongside co-defendants, Kavala was first acquitted in February 2020 by the Istanbul 30th Assize Court due to insufficient evidence. However, he was immediately re-arrested on new charges before facing an aggravated life sentence without the possibility of parole in April 2022 from the Istanbul 13th Assize Court.
Mounting Pressure From International Watchdogs
International organizations including Amnesty International and the Turkey Litigation Support Project have monitored the case closely. Eve Geddie, Director of Amnesty International’s European Institutions Office, stated that Türkiye has defied two previous binding rulings from the court in the Kavala case and that this obstruction of justice must end. Ayşe Bingöl Demir, Director of the Turkey Litigation Support Project, added that Europe’s highest human rights court confirmed beyond doubt that the prosecution and conviction were politically flawed from start to finish.
A Broader Crackdown on Political Dissent
This legal battle forms part of a broader crackdown on dissent across Türkiye following the attempted coup in July 2016. High-profile figures facing similar prosecutions include former People’s Democratic Party leaders Selahattin Demirtaş and Figen Yüksekdağ, who remain imprisoned despite European Court rulings ordering their release. In addition, Istanbul Mayor Ekrem İmamoğlu faces a trial involving 413 defendants where prosecutors have pursued potential multi-year sentences, while hundreds of activists and lawyers faced pretrial detentions around recent political demonstrations and international summits in Ankara.
A Defining Test for International Law
The Council of Europe’s Committee of Ministers reviewed the implementation of the Kavala judgment during meetings in March 2026, noting that Türkiye remains in serious breach of its obligations under the European Convention on Human Rights. Because Turkish authorities have consistently ignored binding international orders and domestic court decisions, human rights advocates warn that the European Convention system faces a defining test.
