Allegations and Court Proceedings
Declan Stubbs, of Bolbrook Drive, Tallaght, appeared before Dublin District Court on Saturday, where Judge Catherine Ghent presided over the bail hearing. Mr. Stubbs faces charges related to an incident at St. John’s House on High Street, where he is accused of causing €1,000 worth of damage by kicking a door. The prosecution, represented by Garda Gavin Cribbin, detailed a series of connected charges, including trespassing at the IPAS centre, a minor assault on a named male, resisting arrest, and using threatening, abusive, or insulting words or behavior while intoxicated.
Garda cribbin objected to bail, citing the seriousness of the alleged offences and expressing concerns that Mr. Stubbs might interfere with staff or residents at the IPAS centre. The court heard that Mr. Stubbs was removed from the building after allegedly assaulting a security guard. Video footage of the incident was presented, and Garda Cribbin informed the court of claims that Mr. Stubbs had expressed “extremist political, anti-immigration views.” Mr. Stubbs’ phone was seized as part of the investigation.
Defense Arguments and Bail Conditions
Kevin McCrave, defence counsel for Mr. Stubbs, argued for his client’s release on bail, proposing specific conditions. He informed Judge ghent that Mr. Stubbs, a father of one, had experienced personal difficulties leading up to the incident, was off his medication, and claimed to have no recollection of threatening anyone due to his intoxication.Counsel also highlighted that Mr. Stubbs is employed full-time and meets his financial obligations.
Judge Ghent granted bail, stipulating that Mr. Stubbs must not go within three kilometres of the IPAS centre, with the exception of attending the local Garda station three days a week to sign on. He is also required to provide his contact number to the authorities.
Crucially, the judge issued a clear directive for Mr.Stubbs to refrain from posting “extremist” content on social media, clarifying that this includes posts inciting hate and/or violence. While the gardaí did not believe Mr. Stubbs had attended immigration rallies, the judge further ordered him not to attend any rallies or marches that could reasonably be considered to incite hatred or violence. Judge Ghent emphasized that any breach of these bail conditions would not be tolerated and would have serious consequences for Mr. Stubbs.
