Background of the Case
Pope Mahawa Diouf, head of the Alliance for the Republic (APR), was placed under a warrant for “dissemination of false news” and ”defamation” on Thursday, october 2, 2025, following his presentation to the prosecutor. this action stemmed from a complaint filed by the Senegalese Rural Electrification Agency (Aser).
Diouf was initially summoned to the Special Cybersecurity Division (DSC) on Monday, September 29, 2025, and later taken into police custody before being referred to the prosecution.
The allegations and Aser’s Response
The legal proceedings were initiated after diouf, appearing on the TFM program Faram Facce on September 17, 2025, accused Aser of a 37 billion FCFA (approximately $61 million USD as of October 3, 2025) diversion of funds. Aser has strongly contested these accusations, asserting they damage the agency’s reputation and public trust.
Jean Michel Sène, Director General of Aser, filed the complaint, deeming diouf’s statements “serious” and harmful to the agency’s image.
Freedom of expression vs. Criminal Duty
The case has sparked debate regarding the balance between freedom of expression and criminal responsibility, particularly within the context of political dialog in Senegal’s media landscape. The situation highlights the challenges of navigating these issues in a politically charged habitat.
