What Happened: Overturning Roe v. Wade

On June 24, 2022, the Supreme Court of the United States issued its decision in Dobbs v. Jackson Women’s Health Organization, effectively ending the constitutional right to abortion. the 6-3 ruling upheld a Mississippi law banning abortion after 15 weeks of pregnancy, directly challenging the precedents set by Roe v. Wade (1973) and Planned Parenthood v. Casey (1992). Justice Samuel Alito delivered the majority opinion, arguing that the Constitution does not explicitly mention abortion and that the right to abortion is not deeply rooted in the nation’s history and tradition (Supreme Court, Dobbs v. Jackson Women’s Health Organization, June 24, 2022).

The Dobbs decision did not ban abortion nationwide, but instead returned the power to regulate or prohibit abortion to individual states. This triggered a wave of legislative action across the country, with some states enacting near-total bans, while others moved to protect abortion access.

The Legal Background: Roe and casey

Roe v.Wade, decided in 1973, established a woman’s constitutional right to an abortion, based on the right to privacy under the Fourteenth Amendment. The Court used a trimester framework, granting states more regulatory power as the pregnancy progressed (Legal Details Institute, Roe v. Wade, Cornell Law School).

In 1992, Planned Parenthood v. Casey reaffirmed the right to abortion but replaced the trimester framework with the “undue burden” standard. This meant states could not place ample obstacles in the path of a woman seeking an abortion before viability – generally considered to be around 24 weeks (Legal Information Institute, Planned Parenthood v. Casey, Cornell Law School). The Dobbs decision explicitly overruled both Roe and Casey.

State Responses: A Divided Landscape

Following the Dobbs decision, states responded swiftly. as of November 8, 2023, the landscape is sharply divided:

  • Bans in Effect: At least 14 states have near-total bans on abortion, with limited exceptions. These bans were often triggered by “trigger laws” designed to take effect if Roe v. Wade were overturned (Kaiser Family Foundation,State Abortion Policies).
  • Restrictions: Several other states have imposed significant restrictions on abortion access, such as gestational age limits (e.g., six weeks) or mandatory waiting periods.
  • Protected Access: States like California, New York, and Illinois have codified the right to abortion into state law, protecting access even without federal protection (Planned Parenthood, What happens If Roe v.Wade Is Overturned?).
