Post Office IT System Conviction: Court of Appeal Review
Post Office Scandal: Mother’s Conviction Could be ‘touchstone’ for Hundreds of Others
Juliet Shardlow is seeking justice for her mother, Patricia Owen, who was convicted in 1998 of theft.
The Criminal Cases Review Commission (CCRC) is investigating hundreds of potential miscarriages of justice linked to the Post Office’s faulty Horizon IT system, with one mother’s case being described as a potential “touchstone” that could expedite hundreds of others.
Patricia Owen, a sub-postmistress, was convicted of theft in 1998. Her daughter, Juliet Shardlow, is now campaigning for her mother’s name to be cleared. The CCRC is currently examining 30 cases that may be connected to the “Capture” software system, a component of the wider Horizon scandal.
Of these 30 cases, 27 are actively under review by case managers, with the remaining three in the preliminary stages.A meaningful hurdle in these investigations, as highlighted by the CCRC, is determining weather the Capture software was actually in use at the time the alleged offences occurred.
Dame Vera Baird, chair of the CCRC, told Sky News that Mrs Owen’s case “could be a touchstone case.” She added that if Mrs Owen’s conviction is overturned, it would “obviously speed up others that are in the pipeline.”
In a letter to Liam Byrne, chair of the Business and Trade Committee, the CCRC stated that details provided by the Post Office “does not, in most cases, show whether it was installed and in operation at the time of the alleged offending.” The Post Office is reportedly reviewing a “significant amount of data” that might shed further light on this crucial detail.
A spokesperson for the Post Office acknowledged the seriousness of the situation, stating, “While it is not appropriate for us to comment on specific cases, we have been very concerned about the reported problems relating to the use of the Capture software, and we are sincerely sorry for past failings that have caused suffering to postmasters.” They affirmed the Post Office’s commitment to rectifying past wrongs and their full cooperation with the CCRC.
The Post Office scandal, which has seen hundreds of sub-postmasters wrongly accused, prosecuted, and even imprisoned due to flaws in the Horizon accounting software, continues to unfold, with many still fighting for justice and compensation. The outcome of cases like Patricia Owen’s could prove pivotal in bringing closure to many more affected families.
