“Through the ‘procuratorial + administrative’ work model, we can further gather joint efforts to protect wild animals.” On October 25, the People’s Procuratorate of Chayouqian Banner in Ulanqab City contacted the Banner Forestry and Grassland Bureau and the Banner Forestry and Grassland Bureau on an illegal hunting and execution reverse connection case. When the Public Security Bureau held a joint meeting, representatives of the administrative agencies present said this.

In June 2023, Wang illegally hunted three hares in the Sanshengying Natural Village Hunting Area of ​​Jiantan Village, Bayin Town, Chayouqian Banner without obtaining a hunting license. After identification, the hare hunted by Wang is a terrestrial wild animal with important ecological, scientific and social value. In October of the same year, the local public security agency transferred the case to the Chayouqian Banner People’s Procuratorate for review and prosecution. After review, the prosecutor determined that Wang had committed the crime of illegal hunting, but the crime was minor, and he had to surrender, plead guilty, and accept punishment, so he decided not to prosecute him. Afterwards, in accordance with the relevant regulations on the reverse connection of executions, the criminal prosecution department of the hospital transferred the case to the administrative prosecution department for review. After reviewing the case, the administrative prosecutor believed that Wang’s behavior violated the relevant provisions of the Wildlife Protection Law and he should bear administrative responsibility according to law. In order to eliminate blind spots in accountability and avoid “impunity without punishment”, in January this year, the People’s Procuratorate of Chayouqian Banner issued a procuratorial opinion to the Banner Forestry and Grassland Bureau, urging the Bureau to impose administrative penalties on those who were not prosecuted in accordance with the law. After receiving the administrative penalty decision, Wang paid the fine in time and built a public welfare warning sign in the game reserve at his own expense.

The case handling is over, but the prosecutor’s work does not stop. By handling this case, this year the Chayouqian Banner People’s Procuratorate, the Banner Forestry and Grassland Bureau and other departments created a “procuratorial + administrative” working model, established a normalized communication and collaboration mechanism, and actively promoted the field of wildlife protection by giving full play to the administrative prosecutorial function. Work on the reverse connection between executions and do a good job in the “second half” of non-prosecution cases. At the same time, the court further promoted the positive interaction of “procuratorial + administrative” and achieved a seamless connection between criminal penalties and administrative penalties. The establishment of the “procuratorial + administrative” working model provides a replicable working model for handling reverse execution cases, effectively promotes source prevention and treatment of both symptoms and root causes, and achieves the good effect of “handling one case, managing one area, and benefiting one party” .

In addition, the institute, together with the Chayouqian Banner Forestry and Grassland Bureau and other administrative agencies, carried out publicity activities on the protection of wild animals and popularized laws and regulations such as the “Wild Animal Protection Law of the People’s Republic of China” and the “Regulations of the People’s Republic of China on the Protection of Wild Plants” to the public.
