A federal judge in Chicago has rejected an emergency request from embattled R&B singer R.Kelly to be released from prison to home confinement. The decision comes amid claims from Kelly that prison officials are plotting against him.
Kelly, 58, is currently serving a 30-year sentence in a North Carolina prison on racketeering and sex crime charges. Judge Martha Pacold ruled that Kelly filed the request in the wrong court, citing a lack of jurisdiction.
“Kelly has not demonstrated a legal basis for this court’s jurisdiction,” Pacold wrote, denying the motion.
Beau Brindley, Kelly’s attorney, expressed disappointment with the ruling, stating that kelly remains in “imminent” danger. “We are not surprised by this ruling as we knew that technical jurisdiction would be a challenge under these circumstances,” Brindley said. “However, we had no choice but to act immediately given explicit evidence of a threat to Robert kelly’s life.”
Kelly’s legal team initiated the release request on June 10, alleging a conspiracy by prison authorities to harm him. He claims that after being placed in solitary confinement, he was given a life-threatening dose of medication. Furthermore, Kelly alleges that he was taken to Duke University Hospital on June 13, where doctors found untreated blood clots requiring surgery.
