Madrid,Spain – Renowned football manager Carlo Ancelotti has been handed a one-year suspended prison sentence and fined €916,000 (approximately $985,000) after being found guilty of two counts of tax fraud in Spain. The sentence, handed down by the barcelona court, stems from AncelottiS failure to declare income from his image rights between 2014 and 2015, during his frist tenure as manager of Real Madrid.
Ancelotti’s Tax Evasion and Image Rights
The case against the Italian coach, who currently manages Brazil’s national team, centered on his use of offshore companies to manage his image rights. Prosecutors alleged that Ancelotti deliberately misrepresented his income by creating a complex structure involving two shell companies. These companies, established in the British Virgin Islands and Panama, were used to receive payments for his image rights, effectively concealing this income from Spanish tax authorities.
The examination, which revealed Ancelotti’s financial dealings, was part of the broader Pandora Papers investigation. This extensive global inquiry, led by the International Consortium of Investigative Journalists (ICIJ), involved over 600 journalists from 150 news outlets. It exposed the financial secrets of numerous world leaders, politicians, public officials, and celebrities, highlighting the use of offshore havens to shield assets and income.
The Pandora Papers, a trove of over 11.9 million confidential files leaked from 14 offshore service firms, detailed how these entities facilitate the creation of shell companies and offshore structures for clients seeking financial secrecy. Ancelotti’s tax arrangements were revealed to be facilitated by Trident Trust, a prominent offshore service provider with operations in numerous jurisdictions, including the British Virgin islands.
image Rights: A Valuable Asset
Image rights grant individuals, notably public figures like Ancelotti, the legal ability to control how thier likeness and persona are used for commercial purposes. These rights can be a significant source of income, and their management, especially through offshore entities, has become a focal point for tax authorities worldwide. The case underscores the scrutiny faced by high-profile individuals regarding the declaration and taxation of income derived from these valuable assets.
The Legal Proceedings and sentence
Prosecutors had initially sought a prison sentence of up to four years and nine months for Ancelotti. Though, due to the sentence being less than two years and Ancelotti’s lack of a prior criminal record, he will not serve jail time. He had previously paid back the full amount of the debt in 2021.
During the proceedings, Ancelotti maintained his innocence, testifying that he had “never thought about committing fraud” and had entrusted the management of his financial affairs to his advisors.
Precedent for Celebrities and Sports Figures
Ancelotti is not the first prominent figure in the sports and entertainment world to face scrutiny from Spanish tax authorities in connection with offshore dealings. Celebrities such as Colombian pop star Shakira and football icon Lionel Messi have also been involved in similar investigations and legal battles concerning their tax obligations in Spain. These cases highlight a pattern of intense examination of financial practices among high-profile individuals residing or earning income in Spain.
