Attorney Kenneth Caruso, representing Rudy Giuliani, has filed a motion to withdraw from Giuliani’s defense in a $148 million defamation case. This case involves allegations from Georgia election workers Ruby Freeman and Wandrea “Shaye” Moss, who claim Giuliani defamed them with false statements about the 2020 election.
Caruso cited a “fundamental disagreement” with Giuliani regarding litigation strategies and a lack of cooperation from him as reasons for the withdrawal. His co-counsel, David Labkowski, also signed the motion, which aligns with New York legal rules allowing attorneys to withdraw under such circumstances.
A judge previously ordered Giuliani to surrender various assets, including a $5 million apartment and luxury items, by October 29. Lawyers for Freeman and Moss claim Giuliani failed to meet this deadline. They alleged Giuliani’s apartment was cleared out before they could proceed with asset recovery. The court extended his deadline to November 15.
Giuliani was found liable for defamation for accusing Freeman and Moss of election fraud. The accusations led to severe threats against the women. A forfeiture trial related to this case is set for January 16, 2025.
The motion does not request legal fees and seeks an exemption from notifying the plaintiffs, citing the sensitive nature of the case. The court has not yet ruled on the motion.
