An appeal⁤ seeking to halt⁤ the sending of leaflets into North Korea ⁢by‌ defector groups adn other organizations​ has been dismissed.⁤ The Justice Party’s appeal was not⁣ accepted.

The Seoul High‌ Civil ⁣Division ‌25-3 announced ⁤on March 30 the dismissal of a lawsuit against three ‍organizations, including abductee groups and the ​Freedom North ​Korean Movement association. The suit was filed by nine‌ individuals, including Kim Chan-woo, chairman of the ⁤Paju City Party, ⁣and Jeon Byung-hun, of the Democratic Party.

The appellate‍ court stated that even ⁢considering the applicants’ objections to the leaflet campaign, there ⁢was no basis​ to overturn the initial judgment, even after reviewing additional evidence.

In November of the previous ⁢year,‌ the nine individuals, including Kim, initiated ‌the legal ​action, arguing ⁣that the leaflets violated the basic rights and pursuit of happiness of border residents ‍and heightened tensions between the two ​Koreas. however, the Uijeongbu District Court, in its initial ruling, stated that no specific basis was provided to directly link the applicants’ ​actions to North Korean armed provocations.

The court also judged that infringement ⁤or concerns over⁤ the right to pursue ​life and happiness are not significantly different from​ the risks experienced by other citizens while the two ⁣Koreas remain divided. ​The ruling further stated,If ‍the risk of North Korea’s armed provocation is used to restrict expressions⁤ that ‍could cause inter-Korean relations tensions,the constitutionally guaranteed freedom of expression might potentially be excessively curtailed.

The abductees’ family​ gathering, which prevailed in the appeal, reportedly has ⁢plans to⁤ proceed with a sending a kidnapped family news event ⁢at the border of Paju City in April.

Officials from Paju ⁤and Gyeonggi province ‌have been patrolling the entire city of ⁤Paju around ​the clock ‌since October of last year, designating ⁢it a dangerous area under the Disaster Safety‍ Act to monitor and prevent the distribution of leaflets into North Korea.
