Former Kyoto Bar Association lawyer arrested for embezzling settlement money from settled civil case

A former lawyer in Kyoto City was arrested by the Kyoto District Public Prosecutors Office on charges of embezzling settlement funds from a settled civil case without handing them over to his client, and forging a copy of the settlement document to avoid detection.

Nobuyuki Kaminaga (55), a former lawyer from Fushimi Ward, Kyoto City, was arrested by the Kyoto District Public Prosecutors Office on suspicion of embezzlement in the course of business and forging and using sealed official documents.

According to people involved, Kaminaga was in charge of a civil trial in which a client sought compensation for damages from a medical corporation, and a settlement was reached at the Otsu District Court in May of last year. Later, the medical corporation paid a settlement amount of 750,000 yen to Kaminaga’s account, but Kaminaga misappropriated the money without handing it over to the client, and changed the payment deadline etc. to prevent discovery. He is suspected of forging a copy of the report and sending it to the client.

The Kyoto District Public Prosecutors Office has not announced whether Kaminaga is the suspect.

Last month, the Kyoto Bar Association filed a criminal complaint against Kaminaga with the Kyoto District Public Prosecutors Office, alleging that he had sent a copy of a settlement statement with altered contents to his client.
