A lawsuit filed against gadjah Mada University (UGM) concerning allegations surrounding President Joko Widodo’s (jokowi) diploma has been declared invalid by the Sleman District Court. The court cited a procedural issue - an “absolute competence exception” – as the reason for dismissing the case, stating it falls under the jurisdiction of either the Public Data Commission (KIP) or the State Administrative Court (PTUN).

The core of the dispute revolves around claims of a “fake diploma” attributed to President Jokowi. Though,the Sleman District Court never reached the merits of the case. According to Agung, a representative involved in the proceedings, the court first had to address a essential procedural challenge.
This challenge stemmed from UGM’s invocation of the “absolute competence exception.” Agung explained this exception necessitates resolution before the lawsuit can proceed. The judges ultimately sided with UGM, determining they lacked the authority to hear the case. This decision effectively invalidated the lawsuit.
Agung further clarified that the court viewed the dispute as pertaining to public information,making it unsuitable for adjudication within the district court system. He suggested the appropriate venues for the plaintiff’s concerns are the KIP,which handles public information disputes,or the PTUN,which deals with administrative law matters.
Plaintiff to Appeal, Claims Misinterpretation of Lawsuit’s Focus
the plaintiff in the case, Komardin, has vowed to appeal the Sleman District Court’s decision to the high court.Komardin believes the court fundamentally misunderstood the nature of the lawsuit.
“We will prepare the documents for this appeal process,” Komardin stated, emphasizing their commitment to pursuing the matter.
Komardin argues the lawsuit isn’t simply about accessing public information. rather, they contend it centers on alleged unlawful acts committed by UGM as the institution responsible for issuing the diploma. They beleive the court shoudl have examined these allegations, focusing on UGM’s role in the controversy surrounding the diploma’s authenticity.
“The polemic surrounding Jokowi’s fake diploma started from the alleged unlawful acts of UGM as the issuing party of the diploma,” Komardin explained. “Thus, according to them, the Sleman district Court should proceed with the lawsuit until completion.”
the appeal must be filed within 14 days of the Sleman District Court’s decision.
