Irish Solicitor Suspended for mishandling Client Funds
Athlone, Ireland – Cormac Lohan, a solicitor practicing in athlone, County Westmeath, has been suspended from practicing law for 12 months due to “serious and extensive” failures in maintaining proper financial records. The suspension, handed down by the High Court, follows a disciplinary tribunal’s finding of professional misconduct against Lohan.
The Solicitors Disciplinary Tribunal (SDT) found Lohan guilty of nine charges, including neglecting to keep accurate books and records. This negligence forced the Law Society to reconstruct client accounts, revealing a shortfall of approximately €20,000 in client funds.
While Lohan admitted to the breaches, he argued that the SDT’s recommended penalties – a restricted practicing certificate and a €15,000 fine – were disproportionate and would lead to the closure of his practice. He maintained that no client funds were lost and denied any dishonesty.
Justice Micheál O’Higgins, presiding over the case, acknowledged Lohan’s previous disciplinary history, noting five prior instances of misconduct. However, he also highlighted that 18 of the initial 27 charges against Lohan were withdrawn, including a serious allegation of a €605,514 deficit in client funds.
“In my view, the fact that this headline charge was dropped is critically important. It fundamentally altered the nature and extent of the prosecution case against the solicitor,” Justice O’Higgins stated.
Ultimately, the judge opted to give Lohan another chance, suspending his practice for 12 months. Lohan will be eligible to resume practicing as a sole practitioner after the suspension, but only if he demonstrates to the Law Society that he has completed ethics training and continuing professional progress courses.
The suspension will end in March 2025.
