Spain Antitrust App Store Pricing Investigation
# Spain Deepens Antitrust Probe into Apple, Citing app Store Pricing Concerns
Spain’s National Commission on Markets and Competition (CNMC) has significantly expanded its inquiry into Apple, accusing the tech giant of “imposing unfair commercial conditions” on developers using the App Store. This move signals continued scrutiny of Apple’s business practices in the European Union, even as the company works to comply with the Digital Markets act (DMA).The CNMC announced it would broaden its probe due to “new evidence” suggesting Apple mandates developers adhere to a specific pricing schedule for selling their apps within its marketplace. Regulators believe this practice could stifle competition, a direct violation of European Union law. The CNMC has a year to conclude its review, emphasizing that this expansion does not predetermine the investigation’s outcome.
In response, Apple defended its App Store, stating it offers a “safe and trusted experience for users and a great business opportunity for developers in Spain and around the world.” the company indicated its commitment to engaging with the Spanish Competition Authority to ensure its perspective is fully understood.
## So Close to DMA Compliance,Yet still Under Fire
This latest development in Spain arrives as Apple is nearing the end of a protracted dispute with the European Commission concerning its adherence to the Digital Markets Act (DMA). Following a recent proclamation of further App Store adjustments in the EU-including more relaxed rules on external payments and a new tiered fee structure-reports suggest the European Commission is likely to approve these changes.
Though, even if the EU officially accepts Apple’s latest concessions, the situation in Spain highlights that the App Store’s established model may continue to face meaningful pressure within the region and, by extension, globally. The CNMC’s deepening investigation underscores the ongoing challenges Apple faces in balancing its proprietary ecosystem with the increasing demands for open competition and fair practices from regulatory bodies worldwide.
