New Delhi: The Supreme Court’s five-judge collegium, led by Chief Justice Sanjiv Khanna, issued a strong rebuke to Allahabad high Court Justice Shekhar Kumar Yadav on Tuesday for his controversial speech at a Vishva Hindu Parishad (VHP) event.
The collegium, which also includes Justices B R Gavai, Surya Kant, Hrishikesh Roy, and A S Oka, expressed concern over the judge’s remarks and emphasized the importance of maintaining the dignity of the judicial office.
Justice Yadav appeared before the collegium to explain his December 8th speech,which had sparked outrage among activist lawyers and politicians. He argued that media reports had selectively quoted from his speech, creating unnecessary controversy.
However, the collegium remained unconvinced, stating that the casual manner in which certain statements were made in the speech was inappropriate for a judge holding a constitutional position.
“Conduct, demeanour, and speech of a High Court or Supreme Court judge, being a constitutional post holder, is constantly under scrutiny,” the collegium stated.”So, they are expected to maintain the dignity of the high office.”
The senior judges stressed that every statement made by a high court or supreme Court judge, both inside and outside the courtroom, must uphold the dignity of the office and not erode public faith in the judiciary.
Justice Yadav, appointed as an additional judge in December 2019 and made permanent in March 2021, is scheduled to retire in April 2026.His speech at the VHP event reportedly expressed support for a Uniform Civil Code (UCC) and allegedly made remarks targeting the Muslim community.
