This legal action follows a previous decision by the 5th U.S. Circuit Court of Appeals, which had moved to stop mail-order access to mifepristone. The appellate court’s order required the medication to be dispensed in person, a restriction that applied even in states that do not have abortion restrictions.
On May 4, 2026, the Supreme Court issued an administrative stay that paused the 5th U.S. Circuit Court of Appeals’ order for one week.
The request for the pause was made by two manufacturers of mifepristone, Danco Laboratories and GenBioPro.
The Supreme Court is expected to reach a decision regarding the status of mail-order access by May 14, 2026.
