Japan’s legal stance on same-sex marriage remains unresolved as conflicting rulings from lower courts continue to shape the national debate, with the country’s highest court poised to deliver a final decision that could redefine marital rights nationwide.

In March 2025, both the Nagoya High Court and Osaka High Court ruled that Japan’s ban on same-sex marriage violates constitutional provisions, specifically Article 24(2) and Article 14(1) of the Constitution, which guarantee equality and individual dignity in family matters. These decisions marked a significant shift in judicial interpretation, suggesting that the current legal framework discriminates against same-sex couples by denying them marital recognition.

However, a subsequent ruling by the Tokyo High Court on November 28, 2025, upheld the constitutionality of the same-sex marriage ban, creating a direct contradiction in the appellate court decisions. This split among Japan’s high courts has intensified anticipation for a definitive ruling from the Supreme Court, which now holds the responsibility of resolving the conflicting interpretations.
