Supreme Court to Hear Landmark Case on Transgender Youth Medical Care

On December 4, the U.S. Supreme Court will hear a significant case about health care for transgender youth. The Biden administration is challenging Tennessee‘s ban on gender-affirming care in the U.S. v. Skrmetti case. This ruling could impact the health care access of approximately 1.6 million transgender Americans, particularly in states like Indiana, Kentucky, and Missouri, where such care is already restricted.

What is Gender-Affirming Care?
Gender-affirming care refers to medical treatments that help align a person’s physical characteristics with their gender identity. This includes puberty blockers, hormone therapy, and sometimes gender-affirming surgeries. According to 2021 data, about 42,000 minors were diagnosed with gender dysphoria, but only a small fraction received these treatments—1,400 for puberty blockers and 4,000 for hormones.

Medical Community Support
Almost every major medical organization in the U.S., including the American Medical Association and the American Psychiatric Association, supports gender-affirming care for minors. These organizations cite studies showing that such care can lead to improved mental health outcomes, including reduced depression and anxiety. However, critics argue that the research quality is inadequate and highlight potential harms.

The Supreme Court Case
The case arises from Tennessee’s 2023 law banning gender-affirming care for minors. After a lawsuit from affected families and federal government intervention, a federal judge initially paused the law. However, upon appeal, a higher court allowed it to take effect, leading to the Supreme Court’s involvement.

Opponents of the law claim it constitutes sex discrimination, as it restricts care for transgender youth while allowing similar treatment for cisgender youth. They argue that the law should be subjected to rigorous legal scrutiny. Supporters of the law counter that it involves standard regulations for minors regarding medical care.

Possible Outcomes
The Supreme Court could rule in several ways:

  1. For the Biden Administration: Striking down the law would likely end similar bans across the country.
  2. For Tennessee: Upholding the law could reinforce other discriminatory laws aimed at transgender individuals.
  3. Middle Ground: The Court may recognize the law as sex discrimination but send the case back to a lower court to determine its justification.
