Five Years Ago: Surveillance, Section 230, and Fortnite
in 2020, the specter of unchecked surveillance loomed large.The Secret Service, like other law enforcement agencies, was found to be exploiting data brokers to circumvent warrant requirements for location data. this raised serious questions about privacy and the erosion of constitutional protections.
Meanwhile, in Massachusetts, a court stood firm, insisting that law enforcement obtain warrants for long-term video surveillance of people’s homes. This victory for privacy rights highlighted the ongoing tension between security and individual liberties.
The year also saw Senator Lindsey Graham launching an attack on Section 230, the cornerstone of internet free speech, revealing a essential misunderstanding of how the internet works. RFK Jr. filed a lawsuit against Facebook. And the Epic/Apple fight over Fortnite continued.

Fast forward to 2015, and the digital world was grappling with different challenges.Ashley Madison was abusing the DMCA following its disastrous data leak. ContentID trolls were on the rise on YouTube, exploiting the platform’s copyright system for financial gain. Carl Malamud called for a three-strikes policy for takedown abuse.Twitter offered a ridiculous excuse for shutting down services that highlighted deleted tweets from politicians. Google lobbied against real net neutrality in India. The Pokemon Company shut down a Pokemon party at PAX. Universal Music took down a parody of a Nirvana song.
Fifteen years Ago: Condoms, Lawsuits, and Grandstanding Attorneys General
In 2010, Warner Bros. got upset about “Harry Popper” condoms.LucasFilm got upset about a company called “Jedi Mind”. Madonna was sued for selling clothes under the name “Material Girl”. Grandstanding attorneys general were making life miserable for tech companies.
