Updated June 04, 2025
Tom Girardi, the once-prominent California lawyer, received a sentence of seven years and three months Tuesday for embezzling settlement funds from clients. U.S. District Judge Josephine L. Staton handed down the sentence, also requiring Girardi, 86, to pay a $35,000 fine and $2.3 million in restitution.
The sentence follows Girardi’s conviction on four counts of wire fraud. He was found guilty of stealing millions from clients, including those with severe injuries and families of deceased individuals.
Girardi, estranged husband of Real Housewives of Beverly Hills star Erika Jayne, 53, could have faced up to 80 years. Jayne filed for divorce in November 2020, citing his declining health; the divorce remains unresolved.
Once a legal powerhouse,Girardi represented victims in major disasters, securing a $333 million settlement from Pacific Gas and Electric,a case dramatized in the film Erin Brockovich.
His legal career ended in 2022 when he was disbarred for client theft. Despite being diagnosed with Alzheimer’s disease and placed under a conservatorship, Judge Staton deemed him competent for trial and sentencing.
Girardi must surrender to authorities by July 17. Former clients, including an Arizona woman whose husband died in a boat accident and victims of a 2010 gas pipeline explosion, testified against him.
Prosecutors presented voicemails where Girardi gave false reasons for delayed payments, often saying, “Don’t be mad at me.”
What’s next
Girardi will report to authorities in July to begin serving his sentence. The restitution process for his victims will begin, though the full extent of recovered funds remains uncertain.
